Why do attorneys refer out cases to other personal injury law firms?

There are four reasons as to why a personal injury firm may refer a case to another firm:

Strategic PI Focus/Not the Right fit for Your Business

Under the already-small umbrella of the personal injury, there are attorneys and firms who only handle certain types of cases. If a case is extremely complex, such as medical malpractice or product liability, an attorney who feels they cannot provide proper representation on that type of case is likely to refer it out.

This can work the other way as well. Some firms that specialize in specific cases, such as medical malpractice, may refer out standard accident cases. If you or your firm specializes in a particular area of personal injury, be sure to let your partner firms know. This helps you stay at the top of their minds and receive referrals for when those kinds of cases show up.

Cashflow Priorities

There are significant upfront expenses that come with building a personal injury case. If a firm feels that they are not able to cover these initial expenses or will not recuperate enough from the case, they will likely refer the case out.

Many personal injury attorney struggle to maintain the resources their firms need to be successful. Insufficient cash flow can often impede progress. High-level cases that require significantly higher upfront costs may overwhelm smaller firms that can’t front the cost; If a high-level case comes to a small firm or sole practitioner, they may refer it out to a larger firm that can cover those associated costs.

Keep in mind referrals can also flow the opposite way, from larger firms to smaller. Establishing relationships within your attorney referral network is important to make sure you are receiving referrals from other firms.

Conflict of Interest

Under American Bar Association rules, personal injury lawyers may not represent a client if “the representation of one client will be directly adverse to another client; or there is a significant risk that the representation of one or more clients will be materially limited by the lawyer’s responsibilities to another client.” When these situations arise, cases are rejected and typically referred out. Although it’s impossible to predict when a conflict of interest will occur, developing strong relationships with other firms in your network will position you to take on these referrals when they do come up.

At Capacity

The last reason a firm may refer out cases is if the case-receiving firm simply doesn’t have the time or personnel to take on a new case. This is rare as firms typically hire new associates to support their growth, but it can happen. By letting other firms know you are ready and willing to take on their overflow, you can generate more case referrals and improve your bottom line.
